Sexual Harassment in California

According to the Equal Employment Opportunity Commission (EEOC), "unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitutes sexual harassment when submission to or rejection of this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance or creates an intimidating, hostile or offensive work environment."

There are two forms of sexual harassment:

  • Quid pro quo (Latin for “this for that” or one thing in return for another): this occurs when a supervisor or person in power requests sexual acts, sex, or a sexual relationship in return for a promotion or raise, or for not firing the employee.
  • Hostile work environment: this is described as sexual harassment in the workplace that creates an offensive or intimidating work environment for the victim. It includes conduct such as unwelcome sexual advances, comments, jokes, innuendoes or threats of a sexual nature, unwelcome touching, hugging, kissing or groping, and even visual displays of a sexual nature such as posters, emails, pictures, etc.
