California and Federal Military Service Discrimination Laws
Two main laws regulate military service discrimination in California:
California Military and Veteran’s Code, Section 394: protects enlisted members of the US military or naval forces from discrimination because of their membership.
Federal Uniformed Services Employment & Reemployment Rights Act (USERRA): protects members of the Armed forces reserve, the National Guard, or other uniformed services from discrimination; this includes veterans as well.
The failure to reinstate a member of the military or reserve after they have performed their ordered military duty is considered military service discrimination, as long as that position or a similar one is available. Decreased compensation, benefits or other assets of employment due to an employee’s military service or based upon an employer’s prejudice regarding military duties is also military service discrimination.
