The case recoveries and results shown on the opening page of this website were achieved by various California law firms unrelated to Legion Counsel and were dependent on the facts of each case. The results will differ if based on different facts. No particular results can be guaranteed by any lawyer. The following is a summary of the facts of the cases portrayed:
Disability Discrimination
Facts: The plaintiff was employed by the defendant County for an
extended period. Plaintiff was diagnosed with agoraphobia and panic disorder making it difficult for him to interact with strangers. His employer had allowed him for years to limit this contact and conduct business primarily over the phone. Thereafter the defendant transferred the plaintiff to a new position requiring personal contact. Plaintiff was told that this was essential for him to retain his position. Plaintiff had always received positive performance reviews. This action was filed against the County, and his supervisor then began to criticize his performance. Plaintiff suffered a nervous breakdown and became suicidal. He was forced to take a leave of absence and never returned to work. Plaintiff claimed he suffered emotional distress, depression, trauma and embarrassment.
Plaintiff contended that defendant engaged in disability discrimination and retaliation.
Result: Verdict for $6,500,000.
Sexual Orientation Discrimination
Facts: Plaintiff was a former police officer with a California city. He
provided testimony against a fellow officer and supervisor for making offensive comments concerning homosexuals. As a result, plaintiff revealed his own status as gay to the chief of police. Later he resigned his position to further his education and was assured that he would be hired back if he decided to return. When he requested to return, plaintiff was denied based upon deficient credit. Plaintiff asserted that his credit hadn’t changed since he was first hired.
Plaintiff claimed future lost earnings and employment benefits, as well as pain and suffering and harm to his reputation for discrimination and retaliation.
Result: Verdict for $431,000.
Racial Discrimination
Facts: The six plaintiffs, five African-Americans and one Caucasian,
were employed by the defendant company. They were terminated by defendant who contended they were at-will employees. Defendant also claimed that there existed good cause for termination based upon complaints of a client. Plaintiffs contended that the real reason for termination was racial discrimination and that under their contracts they could only be fired for good cause.
Plaintiffs claimed damages for wage losses, pain and suffering and attorneys fees.
Result: Verdict for $1,781,947
Wrongful Termination
Facts: Plaintiff was a salesperson employed by the defendant
company which sold complex software to big businesses. Plaintiff was assigned to work on a renewal of a five year contract with a major client, which did occur, providing for $28 million in payments to defendant company over five years. Defendant fired Plaintiff who claimed that this was done to avoid paying him commission for the job and that this violated the implied covenant of good faith and fair dealing. Defendant contended that plaintiff had been paid in full and that he did his job poorly.
Result: Verdict for $1,364,737
Whistleblower
Facts: Plaintiff was a consultant who brought action under the federal
and state False Claims acts, claiming that the defendant medical center inflated its cost reports to Medicare and Medi-Cal. The defendant asserted that all its reports were accurate and proper.
Plaintiffs sought damages for the amount of the wrongly claimed costs.
Result: Settlement for $2,049,451.
Age Discrimination
Facts: Some forty-seven plaintiff employees filed charges with EEOC
alleging that they were discriminated against in promotion because of their age, 40 years and older, in violation of the Age Discrimination in Employment Act. Defendants denied that unlawful discrimination occurred.
The Consent Decree provided for both dollar damages and various requirements for the employer to take future actions designed to discourage such discrimination toward employees.
Result: Settlement for $2.1 million
Family Leave Violation
Facts: Plaintiff was employed by defendant. Plaintiff missed work
indicating that she was suffering from depression and stress supported by a doctor’s note. Soon thereafter, plaintiff was advised that her position had been eliminated due to re-organization. Plaintiff contended that she was singled out for claiming entitlement to leave under the Family Medical Leave Act. Defendant claimed that plaintiff’s position was no longer needed and that she had poor job performance.
Result: Settlement for $220,000.
Gender/Pregnancy Discrimination
Facts: Plaintiff was a grade school teacher employed by the
defendant school district. She claimed that the principal discriminated against her because of her pregnancy, by failing to provide a private room for her to pump breast milk, making improper comments and interfering with her work. She was given notice that she would not be rehired and this was confirmed by the school board. Defendant contended that it could choose not to retain teachers without cause.
Plaintiff claimed past and future lost wages and benefits.
Result: Verdict: $1,012,720.
